DMCA / Intellectual Property Policy

Notice: Nubya respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international frameworks.
8.1 Policy Statement
Nubya is committed to protecting the intellectual property rights of creators, rights holders, and third parties. The Platform maintains a repeat infringer policy in accordance with applicable law.
8.2 Submitting a Copyright Infringement Notice
If you believe Content on the Platform infringes your copyright, you may submit a takedown notice to Nubya's designated DMCA Agent at dmca@nubya.app. A valid notice must include:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material and information reasonably sufficient to locate it on the Platform (e.g., URL).
- Your contact information (name, address, telephone number, and email address).
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
- Nubya will process valid notices promptly and take appropriate action, which may include removing or disabling access to the infringing material.
8.3 Counter-Notice Procedure
If you believe Content was removed as a result of a mistaken or misidentified takedown notice, you may submit a counter-notice to dmca@nubya.app. A valid counter-notice must include:
- Identification of the Content that was removed and its previous location.
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the relevant courts.
- Your physical or electronic signature.
- Upon receipt of a valid counter-notice, Nubya may restore the removed Content unless the original complainant initiates legal proceedings within the applicable statutory period.
8.4 Repeat Infringer Policy
Nubya maintains a repeat infringer policy. Accounts associated with repeated, credible copyright infringement may be suspended or permanently terminated, consistent with applicable law. Nubya reserves the right to determine what constitutes a repeat infringement in its sole discretion.
8.5 Trademark Complaints
To report trademark infringement, contact legal@nubya.app. Nubya will review complaints and take appropriate action in accordance with applicable law.
8.6 Other Intellectual Property
Any complaints regarding infringement of patents, design rights, database rights, or other intellectual property should be directed to legal@nubya.app with full details of the right claimed and the alleged infringement.
